ECu rules in favour of Supermacs intrademark dispute with MeDonalds

Supermacs has emerged victorious in a trademark battle against McDonald’s, clearing the way for its expansion into the European market. The ruling, issued by the European Court, found that McDonald’s failed to demonstrate genuine use of its trademarks related to “chicken sandwiches” and “foods prepared from poultry products.” Additionally, McDonald’s was unable to prove genuine use of its Big Mac trademark in connection with its restaurants and drive-through outlets.

The court’s decision was based on the lack of evidence provided by McDonald’s regarding the extent of its trademark use, including sales volume, duration of use, and frequency of use, specifically concerning poultry products. This ruling now paves the path for Supermacs to move forward with its plans for growth in Europe.
